Introduction

Welcome to HAIRMDL. These Terms of Service ("Terms") govern your access to and use of HAIRMDL's website, products, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

HAIRMDL provides personalized hair care products and telemedicine consultation services. Our goal is to help you achieve healthier hair through evidence-based treatments and professional guidance.

1. Eligibility and Account Registration

To use HAIRMDL Services, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

You may not use our Services if you are prohibited from receiving products or services under applicable laws.

2. Medical Services and Consultation

HAIRMDL offers telemedicine consultation services through licensed healthcare providers. These consultations are conducted remotely and do not replace in-person medical care. The healthcare provider who reviews your consultation is an independent professional, not an employee or agent of HAIRMDL. A provider-patient relationship is established only when a provider agrees to treat you.

You must provide complete and truthful information about your medical history, current medications, and health conditions. Upload clear, accurate photos if required for evaluation. Follow treatment instructions and dosage recommendations. Contact your provider if you experience adverse reactions or side effects. Inform your primary care physician about treatments received through HAIRMDL.

A healthcare provider may decline to prescribe treatment if they determine it is not medically appropriate for you. This decision is made at the provider's professional discretion.

3. Prescription Requirements and Restrictions

Prescription medications are controlled substances that require a valid prescription from a licensed healthcare provider. By using HAIRMDL's prescription services, you acknowledge and agree to the following:

  • You will not misrepresent your identity, medical history, or current health status
  • You understand that providing false information may result in denial of service and potential legal consequences
  • You will not share, sell, or distribute prescription medications with others
  • You will use medications only as prescribed and directed by your healthcare provider
  • You must reside in a state where HAIRMDL is authorized to provide services

4. Product Orders and Payment

When you place an order through HAIRMDL, you agree to pay all charges at the prices in effect at the time of your order, including applicable taxes and shipping fees. All prices are in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors.

You authorize HAIRMDL to charge your designated payment method for all purchases. You represent that you have the legal right to use any payment method you provide. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, unauthorized transactions, or if a prescription is not approved by a healthcare provider.

5. Subscription Services

HAIRMDL offers subscription services for recurring product deliveries. Your subscription will automatically renew at the end of each billing cycle until you cancel. You authorize us to charge your payment method for each renewal period.

Subscriptions are billed on a monthly, quarterly, or annual basis depending on the plan you select. You will be charged on the same day of each billing cycle. You may cancel your subscription at any time through your account settings or by contacting customer support at info@hairmdl.com or (877) 424-7635. Cancellations take effect at the end of the current billing cycle.

We may change subscription pricing with at least 30 days' advance notice. Continued use of the subscription after a price change constitutes acceptance of the new price. You may modify your subscription through your account settings, subject to availability.

6. Shipping and Delivery

We ship to addresses within the United States in states where we are authorized to provide services. Delivery times vary by location and shipping method selected. Risk of loss and title for products pass to you upon delivery to the shipping carrier. You are responsible for providing an accurate shipping address. We are not responsible for delays or non-delivery due to incorrect address information.

7. Returns and Refunds

Please refer to our Refund Policy for detailed information about returns, refunds, and exchanges. Due to the personalized nature of prescription medications, certain products may not be eligible for return.

8. Intellectual Property Rights

All content on HAIRMDL's website, including text, graphics, logos, images, software, and other materials (collectively, "Content"), is the property of HAIRMDL or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any Content without our prior written permission. Limited use for personal, non-commercial purposes is permitted.

9. User Content and Conduct

You may have the opportunity to submit photos, reviews, testimonials, or other content. By submitting content, you grant HAIRMDL a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for business purposes.

You agree not to violate any applicable laws or regulations, infringe on the rights of others, submit false or misleading information, interfere with or disrupt the operation of our Services, attempt to gain unauthorized access to our systems, use our Services for any illegal purpose, or harass, abuse, or harm other users or our staff.

10. Privacy and Data Security

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal and health information. By using our Services, you consent to the practices described in our Privacy Policy.

We implement industry-standard security measures to protect your data, including HIPPA-compliant systems and encrypted data transmission. However, no method of transmission over the internet is 100% secure.

11. Medical Disclaimers and Limitations

Individual results may vary. Hair regrowth and treatment effectiveness depend on many factors including genetics, age, health status, and adherence to treatment. HAIRMDL does not guarantee specific results.

HAIRMDL does not provide emergency medical services. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

All medications carry potential risks and side effects. Read all medication information carefully and contact your healthcare provider if you experience any adverse reactions. Inform your healthcare provider of all medications, supplements, and herbal products you are currently taking to avoid potential interactions. Some treatments require ongoing monitoring. Follow your provider's instructions for follow-up consultations and lab work if recommended.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAIRMDL, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL HAIRMDL'S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO HAIRMDL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless HAIRMDL and its affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

  • Your access to or use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your misuse of prescription medications
  • Any false or misleading information you provide

14. Dispute Resolution and Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Before filing a claim, you agree to contact us at info@hairmdl.com to attempt to resolve the dispute informally.

Any disputes arising from these Terms or your use of the Services shall be resolved in the state or federal courts located in New Jersey, and you consent to the exclusive jurisdiction of such courts.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website prior to the effective date of the changes. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

16. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice, including if:

  • You violate these Terms
  • You provide false or misleading information
  • We suspect fraudulent or illegal activity
  • We discontinue the Services

You may terminate your account at any time by contacting customer support. Upon termination, you remain responsible for any outstanding charges and your obligations under these Terms survive termination where applicable.

17. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and HAIRMDL regarding your use of the Services and supersede all prior agreements and understandings.
